The council finds that:

A. Large numbers of paraffin or wax containers are being discarded on the sidewalks of the city by children. Such containers, when discarded, become soft from the warmth of the sun and create a waxy, oily, greasy, slippery, dangerous and unsightly condition. The condition is aggravated because the contents of the containers attract large numbers of noxious flies.

B. The discarded wax containers constitute a hazard to pedestrians and make the sidewalks unsafe for foot travel because of the greasy and slippery condition resulting on the sidewalks. Several persons have fallen because of that condition. Such containers are a hazard to the health of the city because of the number of flies attracted to them.

C. Because of the hazard to pedestrians and the hazard to health and safety, the presence of the containers is a public nuisance.

D. This public nuisance can best be abated by prohibiting the retail sale, gift or transfer of the containers to any person under the age of eighteen years in the city.

(a) During the period from January 15th to May 15th of each and every year, it shall be unlawful for any person to permit any animal or fowl manure, excrement or other fly breeding material to remain on or at his premises for a period in excess of seven days.

(b) During the period from January 15th to May 15th of each and every year, all animal or fowl manure, excrement, and all other fly breeding materials, shall be removed at least once a week from all premises, including but not limited to, poultry ranches, poultry yards, dairies, cattle yards, barns, sheds, feeding platforms, coops, and mangers. Every person maintaining or operating a poultry ranch, dairy, or cattle yard shall file with the code enforcement officer a notice specifying the day of each and every week during the period of January 15th to May 15th that he will remove or cause to be removed from his premises all animal and fowl manure, excrement and all other fly breeding materials.

It is unlawful to use any food in a children’s camp unless such food is from a source approved by the director.

Except as provided in this chapter, no person shall possess, keep, maintain or have in his possession or under his control, within the city, any elephant, bear, hippopotamus, rhinoceros, lion, tiger, leopard, panther, ocelot, lynx, cougar, wolf, alligator, fox, raccoon, coyote, monkey, ape, chimpanzee, birds of prey, poisonous reptile, other dangerous or carnivorous wild animal, other vicious or dangerous domesticated animal or any other animal of wild or vicious propensities, without first applying to and receiving a permit from the city of Norco to do so.

Section 8.05.050

Permit–Application fee. No permit shall be granted under this chapter unless there is paid to the city at the time of filing of the application therefor, an application fee in the amount of one hundred dollars for the first animal, and thirty dollars for every animal of the same species thereafter for which a permit is sought. The immature offspring of such animals shall not require additional permits during the period of the permit. An application for a second animal of a different species shall be one hundred dollars. These fees are non-refundable.

Norco residents are known to own many unusual animals. Not uncommonly, these animals have been known to escape captivity and run through town.

(a) Every building or place used for the purpose of illegal gambling as defined by state law or local ordinance, lewdness, assignation, or prostitution, and every building or place in or upon which acts of illegal gambling as defined by state law or local ordinance, lewdness, assignation, or prostitution, are held or occur, is a nuisance which shall be enjoined, abated, and prevented, and for which damages may be recovered, whether it is a public or private nuisance.

Nothing in this subdivision shall be construed to apply the definition of a nuisance to a private residence where illegal gambling is conducted on an intermittent basis and without the purpose of producing profit for the owner or occupier of the premises.

(b) Every building or place used as a bathhouse which as a primary activity encourages or permits conduct that according to the guidelines of the federal Centers for Disease Control can transmit AIDS, including, but not limited to, anal intercourse, oral copulation, or vaginal intercourse, is a nuisance which shall be enjoined, abated, and prevented, and for which damages may be recovered, whether it is a public or private nuisance.

For purposes of this subdivision, a “bathhouse” is to be defined as a business which, as its primary purpose, provides facilities for a spa, whirlpool, communal bath, sauna, steam bath, mineral bath, mud bath, or facilities for swimming.

This law was enacted shortly after the AIDS epidemic came into the News in the 1980′s. Bathhouses were one of the primary places people could go for anonymous sex. This law was designed to curtail exposure to HIV and other STD’s.

It shall be unlawful for any person to advertise, represent, or hold out that any sale of goods, wares, or merchandise is an insurance, bankruptcy, liquidation, mortgage, insolvent’s, assignee’s, executor’s, administrator’s, receiver’s, removal, or closing-out sale, or any particular department of such stock of goods, wares, or merchandise, under the guise of discontinuing business or discontinuing that particular department, or a sale of goods, wares, or merchandise damaged by fire, smoke, water, or otherwise, or a sale of goods from the stock of a bankrupt, receiver, trustee, insurance company, receivership, or trusteeship, or to conduct such sale unless he shall have first obtained a permit to conduct such sale from the City Manager.
